| Trade Adjustment Assistance | |||||||||||||||||||||||||||||||||||||||||||||||||
| As a result of the North American Free Trade Agreement (NAFTA) of December 1993, Congress
added NAFTA-Transitional Adjustment Assistance to the TAA program. This initiative serves U.S. workers
adversely affected by imports from either Mexico or Canada or by a production shift in those countries.
Manufacturing businesses that are forced to close or reduce their staff as the result of increased foreign imports may apply for Trade Adjustment Assistance (TAA) to benefit their affected workers. This program provides training and job search/relocation assistance. Participants may also receive Trade Readjustment Allowances (TRA), paid on a weekly basis to idnidviduals who exhaust their unemployment benefits while they are in training. Worker Adjustment and Retraining Notification Act (WARN)
|
The Worker Adjustment and Retraining Notification Act (WARN) was enacted on August 4, 1988 and
became effective on February 4, 1989. WARN requires, with certain exceptions, that companies with at
least 100 workers must give 60 days or more advance notice of a plant closing affecting 50 or more
full-time workers during any 30-day period or a mass layoff that results in an employment loss of
at least a third of the workforce, at least 50 employees or at least 500 workers during any 30-day period.
| WARN stipulates that a business must notify: 1) any labor union or other group representing workers, or if no employee representative exists, the affected employees; 2) the Dislocated Worker Service Unit of the Texas Workforce Commission; and 3) the chief elected official of the unit of local government in the area where the closing or layoff is to occur. Alien Labor Certification Program |
The Texas Workforce Commission's Alien Labor Certification (ALC) Program is federally funded through a contract
with the U.S. Department of Labor (DOL). For many professional, technical, managerial and skilled occupations, the program
allows employers who have been unable to hire quailfied workers eligible to work in the United
States to file a labor certification application with the Alien Labor Certification Section to bring
foreign workers into the Unites States on a permanent or temporary basis. ALC staff issue a priority date and process the
application, the ALC staff is required to determine the prevailing wage for the occupation in the area of intended employment
and to initiate a work search to recruit and refer qualified U.S. workers for the job opening. The employer is obligated to hire
a U.S. worker if that worker meets the employer's minimum qualifications. The employer can only reject U.S. applicants for job
related reasons. After completion of the correction and recruitment process, the application is forwarded to the DOL's Region VI
office, for certification or denial. The U.S. Department of Justice, Immigration and Naturalization Service also accepts
applications directly for certain shortage occupations such as Professional Nurse.

| Work Opportunity Tax CreditThe Work Opportunity Tax Credit is a federal tax credit used to reduce the federal tax liability of private-for-profit employers. Employers can hire from 8 different targeted groups:
The maximum credit available is $2,400 per eligible worker for the adult target groups. The credit is based on 40% of up to $6,000 in qualified wages during the first year of employment. Rapid Response |
Rapid Response
is an early intervention outplacement service offered to employers and workers affected
by layoff and plant closings that affect 50 or more workers. Rapid Response activities
are designed to transition dislocated workers from initial notification of layoff
to participation in the WIA program with the goal of returning that worker
to productive employment as quickly as possible.

Welfare-to-Work Tax Credit
|
Long-term family assistance recipients who begin work after December 31, 1997, and before
May 1, 1999, can earn their employers up to $8,500 in the Welfare-to-Work Tax Credit if they are
members of a family: |
The maximum credit for new hires employed for 400 or more hours or 180 days is 35 percent of qualified wages for the first year of employment and 50 percent for the second year; qualified wages are capped at $10,000 per year. Note: A person may qualify under both WOTC and Welfare-to-Work (dual status), however, the employer may not claim both credits with respect to the same individual.
